Scaffolding, hoarding and mobile elevating work platform (MEWP)/cherry picker licences
When is a licence required?
If you intend to erect scaffolding/hoarding or operate a MEWP/cherry picker on the highway, then you need a licence (or a permit). The reason a licence is needed to erect a scaffold or hoarding/operate a MEWP on the highway is contained under Section 169 of the Highways Act 1980. Enforcement action may be taken by the council in respect of illegal obstructions of the highway.
Who should apply?
It is the responsibility of the relevant contractor must apply for the required licence. Prior to a scaffold/hoarding or MEWP licence being issued, the relevant contractor must be registered with Sunderland City Council. Once registered, you will then be able to make application.
Application evaluation process
- The relevant contractor must be registered with Sunderland City Council
- You must submit a traffic management (TM) plan or a sketch of works with the application
- You must provide proof of Public liability insurance with a minimum cover of £5million

Will 'tacit consent' apply?
No. 'Tacit consent' does not apply.
It is in the public interest that the authority must process your application before it can be granted.
Our target timescale for processing a correctly completed application is usually two working days, from the time all documentation and fees have been submitted, however, this is dependent upon the nature of the works and the reasons for occupying the road.
