Notification of interest

The Licensing Act 2003 allows a person with a property interest in any premises within the council's area to give notice of their interest in that property to the council.

S178 of the Licensing Act 2003 allows a person with a property interest in any premises within the council's area to give notice of their interest in that property to the council.

When submitted the notice lasts for a period of 12 months beginning on the day it is received by the council.

During this period, the council must notify the notifier of any licensing applications which affect these premises and also of the right to request a copy of the information held in the Licensing Register in respect of this premises.

Eligibility criteria

In order to have a property interest in premises, you must satisfy one of the following conditions:

  • Have a legal interest in the premises as a freeholder or leaseholder
  • Are a legal mortgagee in respect of that premises
  • Are in occupation of the premises
  • Have a prescribed interest in the premises

Application evaluation process

Once a notification has been received, the council will acknowledge its receipt.

The application fee which must accompany a notification of interest is £21.00
